2. General Rules

2.a These General Terms and Conditions (GTC) govern the use of the Provider’s accommodation and services.
2.b Special, individual conditions are not part of the General Terms and Conditions published here.
2.c These General Terms and Conditions do not preclude the conclusion of separate agreements with travel agents and organizers, with varying conditions appropriate to the type of business on a case-by-case basis.

3. Contracting Party

3.a The services provided by the Provider are utilized by the Guest.
3.b If the order for services is placed directly by the Guest with the Provider, the Guest is the contracting party. The Provider and the Guest together – if the conditions are met – become contractual parties (hereinafter referred to as Parties).
3.c If the order for services is placed with the Provider by a third party (hereinafter referred to as Intermediary) on behalf of the Guest, the terms of cooperation are governed by the agreement concluded between the Provider and the Intermediary. In this case, the Provider is not obliged to verify whether the third party lawfully represents the Guest.

4. Formation of the Contract, Booking Method, Modification, Notification Obligation

4.a Upon receipt of a verbal or written inquiry from the Guest, the Provider will send an offer. If no specific booking is received within 48 hours of sending the offer, the Provider’s offer commitment ceases.
4.b The contract is formed upon the Provider’s written confirmation of the Guest’s written or verbal booking. Verbal bookings, agreements, modifications, or verbal confirmations by the Provider do not constitute a contract.
4.c The contract for the use of services is for a specified period. If the Guest permanently leaves the accommodation before the specified period expires, the Provider is entitled to the full value of the service stipulated in the contract. The Provider is entitled to re-sell the room vacated before the expiry date. Any extension of the service use initiated by the Guest requires the Provider’s prior consent. In this case, the Provider may stipulate reimbursement for services already rendered.
4.d Modification and/or amendment of the contract requires a written agreement between the parties.

5. Cancellation and Withdrawal Conditions

5.a Unless the Provider has specified otherwise in its offer, services can be cancelled without penalty up to 16:00 local time on the 2nd day prior to the day of arrival.
5.b If the contracting party, despite contractual stipulation, has not secured the use of services by advance payment, credit card guarantee, or other contractually agreed method, the Provider’s service obligation ceases after 16:00 local time on the 2nd day prior to the day of arrival.
5.c If the contracting party has secured the use of services by advance payment, credit card guarantee, or other contractually agreed method, but does not arrive by 24:00 local time on the day of arrival, and/or does not notify their non-arrival in writing in advance, the Provider will enforce the full amount specified in the contract as a penalty. In this case, the Provider will hold the accommodation for the contracting party until 12:00 noon on the day following the arrival day, after which, in the absence of arrival and notification, the Provider’s service obligation ceases.
5.d The Provider reserves the right to withdraw from the performance of services ordered and confirmed by the Guest no later than 30 days prior to the commencement of service use – by a written declaration sent to the Guest – with the simultaneous refund of any advance payment made by the Guest in cash or, in the case of advance payment made via Széchenyi Recreation Card (SZÉP Card), a refund to the SZÉP Card.
5.e For services subject to special conditions, promotions, group travel, or events, the Provider sets different terms and conditions as stipulated in a separate, individual contract.

6. Prices

6.a The room rates for the apartments operated by the Provider are displayed on the apartment house website (www.sunsetapartmanhaz.hu).
6.b The Provider may freely change its advertised prices without prior notice.
6.c When communicating prices, the Provider indicates the legally regulated rate of the tax content (VAT, IFA*) applicable at the time of the offer. The Provider will pass on additional burdens due to changes in the effective tax law (VAT, IFA*) to the contracting party, with prior notice. (*IFA = local tourism tax, the amount of which is determined by local government decree.)
6.d Current discounts, promotions, and other offers are advertised on our website (www.sunsetapartmanhaz.hu).

7. Payment Method, Guarantee

7.a The Provider requires payment for services rendered to the contracting party no later than prior to arrival, before check-in to the apartments.
7.b The Provider may request a credit card guarantee (50% of the total amount), during which the value of the ordered and confirmed service will be blocked on the credit card.
7.c The Provider may request an advance payment for a portion or the full amount due.
7.d The contracting party may settle the cost of services in HUF and/or any other currency accepted by the Provider. In this case, conversion and invoicing will be based on the Provider’s bank’s foreign currency buying rate valid on the Guest’s arrival day.
7.e The Provider accepts cashless payment methods (credit card, Széchenyi Recreation Card, and, based on a separate agreement, gift vouchers, etc.), the current list of which will be provided to the contracting party upon request. It is advisable to specify the chosen cashless payment method already during booking.

8. Method and Conditions of Service Use

8.a The Guest may occupy the room or apartment from 15:00 on the day of arrival (Check-in) and must vacate it by 10:00 AM on the last day of stay (Check-out).
8.b The apartment can fundamentally only be used by the number of persons for whom the contract was made.
8.c When accommodated in an apartment with parents, accommodation is free for children up to 3 years of age. For 2 adults arriving with more than one child under 4 years of age, the cost of one extra bed is payable.
8.d The current price list contains the fees payable for children over 4 years of age.

9. Pets

9.a The Provider does not permit pets within the Apartment House premises. Should the Provider and the Guest agree on the bringing of a pet, the Guest is obliged to familiarize themselves with, acknowledge, and adhere to the relevant regulations of the accommodation at the latest upon arrival. The Guest can inquire about the current regulations on the apartment house website prior to arrival and by contacting the apartments using the provided contact details.
9.b The Guest is fully responsible for any damage caused by the pet.

10. Refusal of Contract Performance, Termination of Service Obligation

10.a The Provider is entitled to terminate the service contract with immediate effect, thus refusing to provide services, if:
10.a.1 the Guest behaves in a manner contrary to the hotel’s house rules,
10.a.2 the Guest uses the provided room or facility improperly,
10.a.3 the Guest behaves objectionably, rudely, is under the influence of alcohol or drugs, or exhibits threatening, offensive, or other unacceptable behavior;
10.a.4 the Guest suffers from an infectious disease;
10.a.5 the contracting party fails to fulfill their payment obligations specified in the contract by the stipulated deadline.
10.b In case of force majeure, the contract terminates, and the parties will settle accounts regarding services rendered.

11. Accommodation Guarantee

11.a If the Provider’s apartment house is unable to provide the services specified in the contract due to its own fault (e.g., overbooking, temporary operational problems, etc.), the Provider is obliged to arrange for the Guest’s accommodation immediately.

12. Guest Illness, Death

12.a Should the Guest fall ill during the period of service use and be unable to act on their own behalf, the Provider will offer medical assistance.
12.b In the event of the Guest’s illness/death, the Provider is entitled to cost compensation from the sick/deceased’s relative, heir, or bill payer. This includes potential medical and procedural costs, the value of services utilized prior to death, and any damages to equipment or furnishings related to the illness/death.

13. Rights of the Contracting Party

13.a Under the contract, the Guest is entitled to the proper use of the ordered room and those facilities of the accommodation that fall within the scope of standard services and are not subject to special conditions.
13.b The Guest may lodge a complaint regarding the performance of services provided by the Provider during their stay at the accommodation. The Provider undertakes to handle complaints submitted in writing and duly acknowledged (or recorded in minutes by the Provider) during this period.
13.c The Guest’s right to complain ceases after their departure from the accommodation.

14. Obligations of the Contracting Party

14.a The contracting party is obliged to pay the cost of the services ordered in the contract by the date and in the manner specified in the contract.
14.b The Guest ensures that children under 14 under their supervision are only present in the Provider’s apartments under adult supervision; parents bear full responsibility for any damage caused by the child.

15. Liability for Damages of the Contracting Party

The Guest is responsible for all damages suffered by the Provider or a third party due to the fault of the Guest, their companion, or other persons under their supervision. This liability also exists if the injured party is entitled to claim compensation directly from the Provider.

16. Rights of the Provider

If the Guest fails to fulfill their obligation to pay for services used or ordered under the contract but not used (which are subject to penalty), the Provider is entitled to a lien on the Guest’s personal belongings brought into the apartment house to secure its claim.

17. Obligations of the Provider

17.a To provide the accommodation and other services ordered under the contract in accordance with valid regulations and service standards.
17.b To investigate the guest’s written complaint and take the necessary steps to address the problem, which must also be recorded in writing.

18. Liability for Damages of the Provider

18.a.1 The Provider assumes responsibility for any damage suffered by the Guest within its facilities due to the fault of the Provider or its employees.
18.a.2 The Provider’s liability does not extend to damages caused by unavoidable circumstances outside the scope of the Provider’s employees and guests, or those caused by the guest themselves.
18.a.3 The Guest must immediately report any damage suffered to the Provider and provide all necessary information to the Provider that is required to clarify the circumstances of the damage, possibly for drawing up a police report / police procedure.
18.b The Provider is also liable for damages suffered by the staying Guest due to the loss, destruction, or damage of their belongings if the Guest placed them in a place designated by the Provider, or generally intended for this purpose, or in their room’s safe, or handed them over to an employee of the Provider whom they could reasonably consider authorized to receive their belongings. For valuables, securities, and cash, the Provider is only liable if the item was explicitly taken for safekeeping, or if the damage occurred due to a cause for which the Provider is liable according to general rules. In this case, the burden of proof lies with the Guest.

20. Force Majeure

Any cause or circumstance (such as war, fire, flood, adverse weather conditions, power outage, strike, epidemic) beyond the control of the party. Either party shall be relieved from the performance of its obligations under the contract as long as such cause or circumstance persists. The parties agree to do everything in their power to minimize the possibility of such causes and circumstances occurring and to remedy any damage or delay caused thereby as soon as possible.
